To Ask the Court for a Domestic Violence Restraining Order

Step 1: Get and fill out the court forms you need to ask the court for a DV Restraining Order.

Step 2: File your completed forms between 8:00 am and 3:00 pm at:

NOTE: You can file your forms at the Pittsburg and Richmond courthouses if:
  • You live in Contra Costa’s East or West County (link to zip codes), and
  • You are not married to the person you want protection from, and
  • You do not have children together with the other party

Step 3: Serve a copy of your filed forms on the person you want to be restrained.  To learn how you have to serve the forms, click here.

Step 4: Have a Proof of Service form filled out and filed at the Spinetta Family Law Center.  To learn how to do this, click here.

Step 5: Prepare for your court hearing. To learn how to do this, click here.

Step 6: Attend your court hearing. To learn what to expect in court, click here.

NOTE: The court clerk will write date, time and place of your hearing on the form DV-109, Notice of Court Hearing.


Step 7: If the judge signed a Restraining Order to protect you, then you have to file that form at the Spinetta Law Center.  To learn how to do that click here.
