You can file court forms:

In the clerk’s office (Monday - Friday, 8:00 am to 3:00 pm), in an after-hours drop box (Martinez drop boxes are inside, and only available Monday - Friday until 5:00 pm), or by mail.

Clerks of the court can assist you with:

Procedural information about filing your forms, fees, calendaring hearings, and getting answers to questions about your court case. The clerks cannot give you legal advice.

The Appeals clerk prepares and certifies the record for appeals in all types of superior court matters including civil, probate, family law, juvenile and criminal matters to the appropriate appellate court.

If the original case was heard in a branch court, you must file the appeal in that branch court. If the original case was heard in Martinez, you must file the appeal in Martinez.

The civil clerk is responsible for:

  • Accepting filings for civil law documents such as: complaints, petitions, answers, cross-complaints, motions, and dismissals;
  • Examining legal documents for sufficiency of information;
  • Assessing and collecting proper filing fees and accounting for all monies received;
  • Issuing summons, writs, abstracts and other processes;
  • Calendaring various hearings;
  • Preparing legal notices and judgments as prescribed by law;
  • Entering civil, case information into the computer;
  • Answering correspondence and telephone calls from the public; and,
  • Giving procedural information on filings, fees, and calendaring.

NOTE: Limited civil documents can be dropped off in the branch courts, but are only filed in Martinez.  (NOTE: Please allow 5 court days for documents dropped off in branch courts to be filed in Martinez. Documents that must be filed for a hearing in less than 5 court days must be taken to Martinez.)
